fa عقل و کشف ملاکات احکام کلام قدیم کلام قدیم پژوهشي Research <span style="font-family:B Nazanin;">یکی از مباحث مطرح در حوزه دین‌پژوهی که از دیرباز اذهان اهل تحقیق را به خود مشغول کرده، میزان ارتباط عقل و ملاکات احکام است. در نوشتار حاضر با طرح دیدگاه‌های اندیشمندان اسلامی و با استمداد جستن از احادیث در فضای اصلی بحث، به این نتیجه رهنمون می‌گردیم که یکی از ریشه‌های اصلی این مبحث، ارایه پاسخ صحیح به این پرسش است که آیا ملاک و مصلحت حکم شریعت، در خود حکم نهفته است یا در متعلق حکم؟ تأمل در برخی آیات و احادیث، وجود ملاک و مصلحت عقلی در متعلق حکم شریعت را نشان می‌دهد و وجود آن در خود حکم را نفی می‌کند، بر این اساس، در پاره‌ای موارد می‌توان عقلانیت مبنا و حکم شریعت را احراز نمود و با شناسایی مقتضِی حکم شریعت و منتفی داستن موانع، ملاک احکام را کشف کرد. البته کارکرد کشف ملاکات عقلی احکام و بحث از ضرورت آن فقط عبور از نصوص شرعی و ایجاد تشابه بین منصوصات و غیر منصوصات و برانگیختن حساسیت دیرینه اندیشمندان شیعی نیست، بلکه هدف اصلی، ایجاد بستری برای توجه بیشتر به این ضرورت است که در جای خود می‌تواند موجبات بالندگی علمی را فراهم سازد.</span><br> <span style="font-family:B Lotus;"></span> &nbsp;<br> What is the extension to which the act of reasoning and the standards of judgments are interrelated? The author, proposing Muslim scholars` views in the field and relying on traditions, ahadith, has concluded that firstly one has to answer the question: does the standard and expediency of Divine judgment lies in the judgment or in its object? The latter is signified, however, with view to some holy verses and traditions. Therefore, in some cases, one can obtain reasonability of standard and divine judgment. In this way, jurisprudents, when understanding the cause of judgment and in the lack of obstacles, can find the standard of Divine judgments. In the end, it should be stated that the discovery of reasonable standards of Divine judgments and talking on its necessity cannot be considered to be only passing through self-evident religious texts, establishing a kind of resemblance between self-evident religious and self-unclear texts and arousing the deeply rooted sensibility of Shiite scholars.
